The EB 5 regional center program allows investors to place capital into pooled projects that count indirect and induced jobs toward the 10 job requirement under INA Section 203(b)(5). That flexibility comes with a tradeoff: the investor relies on a third party operator to build the project, create the jobs, and return the capital. A poorly chosen project can result in a denied I 526E petition, a stalled I 829, lost investment funds, or all three. Because USCIS does not pre screen project quality for investors, the burden of evaluating a regional center offering falls squarely on the investor and their counsel.
